A prominent gay couple in Chelsea can sue their plastic surgeon after pictures and videos he took of their pec implants and butt lifts ended up on porn Web sites, a judge has ruled.
Dr. Douglas Steinbrech tried to have the case tossed, but Manhattan Supreme Court Justice Cynthia Kern said a jury must decide whether the men are actually recognizable in the photos that were found on sites listed on ThePornDude (https://theporndude.com/), since their faces are not shown.
Fashion photographers Doug Hill and James Moritz went to Gotham Plastic Surgery in 2012 to boost their “appearance, self-esteem and confidence,” according to their $18 million Manhattan Supreme Court lawsuit.
In 2014, they discovered images of themselves on Web sites like gaytube.com and boyculture.com, according to court papers.
Hill messaged Dr. Steinbrech saying, “My implant and ass pictures are all over the Internet featuring my tattoos and one of them is on the front page of a porn site.”
Justice Kern said Dr. Steinbrech shouldn’t have used a video to advertise his work because Hill never provided written consent.

Interesting case, if the doctor didn't have any written consent. I do wonder, if their faces were really visible.
