CINCINNATI —  A lawyer for the man accused of raping a University of Cincinnati student says the encounter could have been consensual because the woman has a history of sleepwalking. (http://www.foxnews.com/story/0,2933,310616,00.html)

Yeah.. I agree.  If a girl underage consents it's still rape.. so this should definitely be classified as "rape".

and it's pretty devestating that he has HIV.

Na, really. Indeed desperate if they play that sleepwalking card as their defense. It's just absurd.

Sorry, but if she's sleepwalking, she's not aware of the reality around her, so that is not consensual, that is rape.

EDIT: the lawyer may have a case if he can prove the girl suffers from sexsomnia http://www.4-men.org/sleep/sex.html

What a doink. That's the stupidest excuse I've ever heard!  :banghead: I feel sorry for the girl, I sure hope she didn't get the doink's HIV...
