I thought it was going to be someone from the United States but I guess other parts of the world have the same lawsuit happy people.

And I hope the driver does get jail time, he made the family greive twice, first their son and then a car. :thumbdown:

Since it's been 3 years since the accident happened I guess the accident was probably caused by the cycling boy. And if it's the case, I think his insurance company should pay the damages. Is dying an excuse to avoid paying damages? I don't think so.

^ I read a news article about this incident in which it said, though it was dark and the boy was not wearing anything reflective, the "family won 33,000 Euros (£24,479) compensation from Delgado's insurance company after the firm acknowledged he had been driving at excessive speed".

So, basically he sued the family on the grounds that the boy was not visible enough for his liking. Nevermind that he might have seen him in time if he hadn't been speeding. Also, this guy's car is a luxury car. Which means he has money. He's not destitute. It's just a car and it can be fixed (most likely only at the expense of his insurance company and a notch on his driving record). And yet he has the nerve to say "I'm also a victim in all of this".

If you ask me, driving at excessive speeds puts you at fault way more than not wearing reflective clothing.

Edit: It's also important to note that it says he sued the boy's parents, not the boy's insurance company. This is most likely because he knows that he would flat out lose a case against the insurance company because his own insurance company acknowledged his excessive driving speed. Pretty damn low road to take, if you ask me, just to save a few dollars.

Does the excessive speed mean speeding over the speed limit, or just excessive speed in these conditions without going over the speed limit and breaking the law?

If he really was speeding, I guess he should've been found guilty for manslaughter or something.

It's always easy to say afterwards that a driver was driving a excessive speed for a situation.
